Good afternoon

Thank you to the AEC Chairman for letting me join your forum. I am a Solicitor acting on behalf of a client who drove the AEC Mercury and AEC Mandator lorries in late 60s and 70s. My client now suffers with hearing loss due to alleged noise exposure whilst in the cabs. We are not pursuing AEC but the insurers of his employer.

I am trying to obtain information from drivers who may be able to assist with information relating to the noise levels in the cabs of the vehicles mentioned above and also to identify any history noise studies/surveys that may have been performed.

Also, if there are examples of the vehicles in existence which could be inspected by a noise expert to actually measure the noise levels, this would be very helpful.

Any assitance is much appreciated.

Can I first ask the question, who is paying & how much? There is a common misunderstanding out there that our vehicles, time & knowledge is for the taking. Maybe you could indicate the following:

1) What is the hourly rate you are paying for such information?

2) Should a vehicle be used for noise assessment, apart from the cost of the vehicle, what will be the insurance situation? Many are excluded for hire and reward purposes. This is no joke - Section 165 of the Traffic Act provides the Police with powers to impound vehicles used without valid insurance, to say nothing of the 6 points on a driver's licence.

These old vehicles cost owners vast sums in restoration, paint, oil, spares ETC and seldom earn a penny if at all.

Sorry to hear about your client's hearing issues. I am sure a club member would be willing to help & I hope you case progresses in the right direction for you.

I am not going to tell you why your case is going to fail, I'll leave that for you to waste hours of your no doubt fabulously but undeservedly expensive time to discover.

I suggest you go back to pestering people about PPI, the pickings are likely to be greater. Oh of course, the gravy train is approaching the last set of signals before the terminus.

I am sorry for your client, but this is a waste of his money.
